Gary Gauvin and David Ingram discuss Cross-Border Canada/US tax

Gary Gauvin started out as an employee of David's, then moved to being a partner in the national CEN-TA chain, then moved on to his own cross-border tax practice out of Texas. The two have remained in contact over the years and share information and answer each others' questions on this complex and challenging subject.
We're sure you'll learn a lot about what it takes to deal with even as simple a thing as being a US citizen living in Canada, or a Canadian working in the US but having a Canadian RRSP.
Individual Segments:
- Introduction - Gary Gauvin, one of David's former employees, then partners, now in private practice as a cross-border tax preparer. TN Visa holders, since 2005, have to be paid as an employee rather than being "self employed"
- Continuation of discussion of Canadians trying to continue to work for their own companies but through the use of TN visas bill to an American company
- Meals and lodging when working as a Canadian for a US firm longer than 1 year is not deductible since TN visa is for 3 years now
- Gary and David answer an emailed question regarding a US LLC owning a Canadian firm that employs the Canadian and incurs only expenses, no income Resource by Treaty for pension income and how it can save more than the preparer's bill - but most preparers don't do it.
- RRSPs and California - must report internal earnings annually. Discussion of various tax departments pushing the limits of rules and regulations to increase their cash flow. David relates how a US Treasury dept. agent "shopped" him to find out how rules were being adhered to by tax preparers.
- Continued discussion of penalties for tax preparers in US and rules and registrations necessary to continue to practice. Jail sentences for being part of tax evasion cases. Multi-jurisdictional tax preparation is hard - "a whole different ball game," says David.
- Registration requirements for tax preparers submitting New York state tax returns.
